On May 25th 2018, data protection laws in the UK will undergo significant change, with the introduction of this new legislation comes increased responsibilities as your accountants/tax adviser. At Bramptons Accountants we take your privacy and the privacy of the information we process seriously. We will only use your personal information you give us access to, under this contract, to administer your account and to provide the services you have requested from us.

Your rights under General Data Protection Regulation (GDPR)

GDPR Legislation states that you have the following rights in regards to your personal data:

  1. The right to be informed - transparency in regards to your personal data held by us and our data retention strategy.
  2. The right of access - you have the right to ask about what personal data is being processed and are entitled to receive a copy provided to you within one month.
  3. The right to rectification - you are entitled to have personal data corrected if it is incorrect or incomplete.
  4. The right to erasure - you can request the deletion or removal of personal data in specific circumstances.
  5. The right to restrict processing - you can block or suppress the processing of personal data.
  6. The right to data portability - you can request in specified circumstances that your data is supplied in a commonly used format so it can be transferred easily to another data controller, or request that the data is transferred directly to another data controller.
  7. The right to object - you can object to your data being used for specific reasons.
  8. The right in relation to automated decision making and profiling - wholly automated decisions are prohibited unless certain conditions apply.

What is personal data?

Personal data relates to any information about a natural person that makes you identifiable which may include (but is not limited to): Names and contact information i.e. emails and telephone numbers, address, National Insurance numbers, payroll and accounting data.

You agree that we are entitled to obtain, use and process the information you provide to us to enable us to discharge the services, as defined in our Letter of Engagement. Your information is processed by us on a contractual basis.

How will we use the information about you and why?

At Bramptons Accountants we take your privacy seriously and will only use your personal information to provide the services you have requested from us, detailed in your Letter of Engagement. We will only use this information, subject to your instructions, data protection law and our duty of confidentiality.

We may receive personal data from you for the purposes of our money laundering checks, such as a copy of your passport. This data will only be processed for the purposes of preventing money laundering and terrorist financing, or as otherwise permitted by law or with your express consent.

Our work for you may require us to pass your information to our third-party service providers and other associated organisations for the purposes of completing tasks and providing the services to you on our behalf. However, when we use third party service providers, we disclose only the personal information that is necessary to deliver the services and we have contracts in place that requires them to keep your information secure and not to use it for their own direct marketing purposes.

We will not share your information for marketing purposes with companies so that they may offer you their products and services.

Security precautions in place about data collected

When you give us personal information, we take steps to make sure that it's treated securely. As a result, while we strive to protect your personal information, we cannot guarantee the security of any information you transmit to us via email or post, and you do so at your own risk. Once we receive your information, we make our best effort to ensure its security on our systems.

To enhance the security of data transmission, we offer the use of a client portal that allows data to be passed instantly and securely between ourselves and you. The client portal, amongst other things, offers two‐factor login authentication and password/document encryption to ensure that your data is held and transmitted securely.

Profiling

We may analyse your personal information to create a profile of your interests and preferences. We may also use your personal information to detect and cut fraud and credit risk.

How long will we hold your data for?

  • Marketing: We do not use your data for marketing activities.
  • Contracted Services: We will hold your data for 7-years in line with our regulatory requirements.

Access to your information, correction, portability and deletion

What is a Subject Access Request?

This is your right to request a copy of the information that we hold about you. We will respond to your request within one month of receipt of the request.
